MAXHUB(US) INC  (hereinafter called “MAXHUB” or “We”) is the controller of your Personal Data. Our registration address is 21076 Bake Parkway, Suite 106  Lake Forest, CA 92630. We are committed to protecting and respecting your privacy. In this regard, we develop this Privacy Policy (hereinafter “the Privacy Policy”) in accordance with the California Consumer Protection Act (“CCPA”) and other applicable laws and regulations to explain how we collect, use, disclose, transfer and store your Personal Data when you use our MAXHUB V / VI / VII Product and the software preinstalled in it (hereinafter “MAXHUB Products”). Before using our MAXHUB Products and submitting your Personal Data, please read the Privacy Policy together with our User Agreement carefully to understand our approach to customer privacy and make choices that you deem appropriate.

 The Privacy Policy only applies to the United States. The Privacy Policy only applies to the Personal Data we collect.

1. Definition

 

 “Affiliated Company” refers to a company that is related to MAXHUB due to joint ownership or control.

  “Third Parties” refer to companies or persons who do not have a related relationship arising out of joint ownership or control with MAXHUB (i.e., a non-Affiliated Company) or other non-related persons. Third parties can be financial or non-financial companies, or persons other than you and MAXHUB.

 Personal Data: refers to any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 Processing: refers to any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Controller: refers to the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.

Collect: refers to the behavior of gaining control over Personal Data, including voluntary provision by the data subject, automatic collection by interaction with the data subject or recording the behavior of the data subject, and indirect acquisition by sharing, transferring and collecting public information.

Delete: refers to the behavior of removing Personal Data from the system involved in the implementation of daily business functions, so that it cannot be retrieved and accessed.

Publicly disclose: the behavior of releasing information to the society or to non-specific groups of people.

Share: refers to the process of Personal Data controller providing Personal Data to other controllers, and both sides have independent control over Personal Data.

Transfer: refers to the process of transferring Personal Data control from one controller to another.

Minor: this term is defined differently under different jurisdictions, e.g., it refers to an individual who is under the age of 18 pursuant to “Privacy Rights for California Minors in the Digital World”in California Code.

 

2. How We Collect and Use Your Personal Data

 

MAXHUB collects Personal Data for more efficient operations and provides you with the best product experience. Our channels for collecting Personal Data include: (1) Personal Data directly provided by you; (2) data recorded by us about how you interact with our products.

 

 The Personal Data we collect depends on the environment in which you interact with MAXHUB, the choices you make, including your privacy settings and the functions you use.

 

a. Personal Data that we collect

 

i. Personal Data directly provided by you

 

Generally, the Personal Data generated when you use software preinstalled in the MAXHUB Products will be stored locally in the device and won’t be transferred to our cloud. Such locally stored Personal Data can only be accessed by the owner of the MAXHUB device, and MAXHUB will not have access to such Personal Data.

However, if you choose to use the specific functions for document or information sharing purpose among different devices,  the Personal Data will be further transferred to our cloud via internet. For instance:

• When you use the Whiteboard function, we will collect the content in the Whiteboard.

• When you use the camera and screen recording function, we will collect photos and screen recording file generated herein.

 • When you use the voting function, we will collect the voting topics and options.

• When you use the document function, we will collect the documents you upload.

• When you use the annotation function, we will collect the annotation page and synthesized annotation file.

• When you use the meeting function, we will collect the relevant meeting information, including the meeting information in your calendar and other meeting information you upload or input.

 

ii. Product usage information

 

 In addition to Personal Data you provide, in the process of using MAXHUB Products, we may collect data including your operation behavior data and other auxiliary data via event tracking and other technical methods, which is adopted for device performance detecting, user behavior analysis and subsequent product optimization.

 
Please note that we DO NOT collect the Personal Data described in this section unless you initiate participating in our User Experience Plan, and your decision of rejecting to our collection DOES NOT interrupt the normal operation of this MAXHUB Product. You can click here to know more regarding MAXHUB Product’s’ User Experience Plan and the Personal Data we will collect.

To support product operation, troubleshooting, and maintenance, your device will generate application log files locally when the user performs certain operations or interactions. After you actively confirm the upload, this log information will be transmitted to our cloud. This data is collected solely for diagnosing problems and ensuring the normal functioning and stability of our products. You can click here to learn more about the log information we collect.

 

 

iii. Additional Information for California Residents

The status of Personal Data collection and disclosure is specified as below:

G. Geolocation data, such as device location.

H. Audio, electronic, visual, and similar information, such as images and audio, video or call recordings created in connection with our business activities.

I. Professional or employment-related information, such as job title as well as employment record and working experience.

J. Education information subject to the federal Family Educational Rights and Privacy Act, such as student profiles.

K. Inferences drawn from any of the Personal Data listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

 

Please note that we do not sell (as defined by the CCPA) any of your Personal Data.

 

iv. Exceptions Where Consent is not Required

MAXHUB will only process your Personal Data after obtaining your consent. The types of Personal Data and the purpose of processing are specified in previous sections. If you have any question regarding our data processing activities, feel free to contact us according to contact information specified in Section 10.

Please note that MAXHUB may also have the right to process your Personal Data without your prior consent under the following circumstances:

(1) processing is necessary for the fulfillment of a contract when the data subject is one of the party(s) or when it is one of the preconditions for the data subject to enter into a contract;

(2) processing is necessary for being compliance with a legal obligation imposed on the controller;

(3) processing is necessary to protect the vital interests of the data subject or of another natural person;

(4) processing is necessary for the public interest or the exercise of official authority vested in the controller;

(5) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of Personal Data, in particular where the data subject is a child.

b. How We Use your Personal Data

 

 We process your Personal Data for purposes described in the Privacy Policy based on your prior consent and our legitimate interests. We also process your Personal Data pursuant to legal obligations imposed on us or to perform contracts between MAXHUB and you such as User Agreement. MAXHUB will strictly comply with the Privacy Policy and its updates to use your Personal Data. If your Personal Data is used for other purposes that is not stipulated in the Privacy Policy, we will additionally obtain your specific consent or other legal basis. Examples of our processing activities are as follows:

 

i. Provide our products and services. The Personal Data we collect will be used to provide you with MAXHUB Products, fulfill the contract between you and MAXHUB to ensure the functionality and safety of MAXHUB products and services, and to prevent and investigate fraud or other improper use.

 

ii. Customer support. We use data to diagnose product problems, maintain MAXHUB Products, and render other services like customer care and customer support.

 

iii. Product improvement. We only use data listed in User Experience Plan to analyze product usage condition so as to constantly create, develop, and improve our products, analyze business operation efficiency, and include new features and functions. For instance, we will use the data from event tracking for product optimization and development, and furnish user profile construction with data basis. We DO NOT use other Personal Data provided by you for product improvement.

 

 We may provide additional information on our practice on Personal Data through product manual, supplementary privacy statement or notice. Some of our websites or functions may have independent privacy statements that specifically describe their way of Personal Data processing. If there is conflict between notices provided when collecting Personal Data or privacy statements of  particular website or function and the Privacy Policy, the notice or supplementary statement shall prevail.

 

3. How We Store Your Personal Data

 If your Personal Data is stored locally, it means that such data is retained in the MAXHUB device you use. The owner of relevant device may have access to such data but MAXHUB does not. For Personal Data which will be transferred to the cloud server according to section 2.a, it will be stored in the following manner:

 (i) the Personal Data collected for purpose of product usage information program will be stored in the cloud server in Germany.

(ii) the other Personal Data will be stored in the United States cloud servers.

 We will strictly abide by the internal retention policy to store your Personal Data. The retention period for Personal Data is the minimum time necessary to achieve the collection purposes, except a longer period required by applicable laws and regulations or your explicit consent. We will delete Personal Data exceeding the above retention period upon expiration.

 

 

4. How We Entrust, Share, Transfer and Publicly Disclose Your Personal Data

 

 We have entrusted Amazon Web Services (AWS) and Microsoft Azure (both are well-known worldwide cloud storage service providers) to store your Personal Data as listed in the Privacy Policy. We have entered into data processing agreements to ensure that appropriate technical and organizational measures are adopted to protect your rights and interests regarding Personal Data.

 And we will share your product usage information with MAXHUB headquarters for the necessary purpose of MAXHUB Products maintenance. In other conditions, we do not share your Personal Data with any other third party such as our partners.

However, if a merger, acquisition or bankruptcy liquidation takes place and a transfer of Personal Data is involved, we will request the new company or organization which obtains your Personal Data to be subject to the Privacy Policy. Otherwise, we will require such company or organization to obtain your consent again.

 Besides, we will only publicly disclose your Personal Data after obtaining your express consent or it is mandatorily required by laws, such as in compliance with subpoena, legal proceedings, legal actions or compulsory request by supervisory department of government agencies. In addition, we may publicly disclose your Personal Data for legitimate interests (if we sincerely believe that disclosure is necessary to protect our rights, ensure your or others’ safety, investigate acts of fraud or respond to government).

 

5. How We Protect Your Personal Data

 

 We have taken safeguarding measures in accordance with industry standards to protect the Personal Data you provided and prevent data from unauthorized access, public disclose, use, modification, damage or loss. In particular:

a. We adopt encryption measures such as TLS and AES. We will ensure the channels and means of Personal Data transferred is strictly encrypted. We periodically review practices regarding data collection, storage and possessing (including physical security measures) to prevent your Personal Data from unauthorized access.

 

b. We use computer system that has limited access and merely allow MAXHUB employees who need to know Personal Data in order to help us process it or authorized staff from service companies to access Personal Data. These people are required to comply with strict contractual confidentiality obligations. Failure to comply with the obligations will lead to legal liabilities or termination of contract with MAXHUB. MAXHUB employees and authorized staff from service companies have no access to the files and documents you upload or display and the data stored locally on your MAXHUB device.

 However, please be attention, even if we undertake reasonable measures to protect your data, there is no website, internet transmission, computer system or wireless connection that are definitely safe. In case of Personal Data security incident where it is likely to result in a high risk to the rights and freedoms of you, we shall communicate the Personal Data breach to you in accordance with the requirements of laws and regulations such as basic situations and possible influence of the security incident, response measures we have taken or will take, suggestions for you regarding self-prevention and risk reduction, remedial measures for you, etc.

 We will inform you in a timely manner by email, mail, telephone, push notification, etc., regarding the relevant situations of the incident. When it is difficult to notify each Personal Data subject individually, we will issue a notice in a reasonable and effective manner. In the meantime, we will take the initiative to report on the handling of Personal Data security incident in accordance with regulatory department’s requirements.

 

6. Your Rights

 

 We respect your rights to Personal Data. Below is a list of your legal rights and the way we protect them. Please note, in case of safety, we may ask to verify your identity before processing your request.

a. Right to Know: We publishes the Privacy Policy to inform you of how we handle your Personal Data. We are committed to the transparency of the use of your Personal Data.

b. Access Right: You are entitled to exercise your access right to visit data.

 c. Right of Rectification: If you find there is a mistake with your Personal Data we process, you are entitled to ask us to make rectifications. When your identity is confirmed, we will rectify accordingly.

 d. Right to Delete: you may make a request to us to delete your Personal Data under the following circumstances:

(1) Our processing of your Personal Data violates the laws or regulations;

(2) We collect or use your Personal Data without your prior consent;

(3) Our processing of your Personal Data violates the agreement with you;

(4) You stop using our products or services;

(5) We no longer provide you with products or services;

(6) Other circumstances stipulated by the laws and regulations.

 e. Right to Restrict Processing: You are entitled to request MAXHUB to restrict processing of your Personal Data under the following circumstances:

(1) You contest the accuracy of your Personal Data, for a period enabling us to verify the accuracy of the Personal Data;

(2) the processing is unlawful and you oppose the erasure of your Personal Data and requests the restriction of their use instead;

(3) we no longer need your Personal Data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims;

(4) you have objected to processing, pending the verification whether the legitimate grounds of us override those of you.

This means we can store your Personal Data but cannot process it.

f. Right of Data Portability: To the extent permitted by laws and regulations, you are entitled to obtain your Personal Data in a structured, commonly used, and machine readable format. For instance, if you decide to change the service provider, this right enables you to reliably and safely move, copy or easily transfer your Personal Data between IT systems without affecting its use.

g. Right of Refusal: To the extent permitted by laws and regulations,, you have right to refuse our processing for these purposes.

 h. Right to Withdraw Consent: If you agree to our processing of your Personal Data but later changes mind, you can withdraw your consent at any time and we must stop processing.

i. Right to Refuse Automated Decision: You have rights not to be bound by automatic decisions (if any), including user profiling. If these decisions will significantly affect your legitimate rights, you can refuse to be subject to automated decisions. We will respond to your request and take appropriate measures when necessary.

 j. Right to Complaint: You are entitled to file a complaint with the data protection authority of your country about our processing of your Personal Data.

k. Additional Rights in France: Residents of France are entitled to provide us with specific directives on the handling of their Personal Data following their passing by getting in touch with us.

l. Additional Rights for California Residents

We recognize and protect your lawful rights under CCPA and other California Law. You may exercise your rights at any time via methods stipulated below. Besides, you also have the following rights:

(1) Right to Know Information Regarding Participation in Data Sharing for Financial Incentives

We will ask for your consent before collecting your Personal Data in connection with offering a financial incentive.

(2) Right to Opt Out of Sale of Personal Data to Third Parties

You have the right to opt out of any sale of your Personal Data by us to third parties. Please note that your right to opt out does not apply to our sharing of Personal Data with service providers, who are parties we engage to perform a function on our behalf and are contractually obligated to use the Personal Data only for that function.

(3) Right to be Free from Discrimination

You may always exercise all rights and we will not unlawfully discriminate against you for exercising your rights under the CCPA.

(4) "Shine the Light" Law

Residents of the State of California also have the right to request information regarding third parties to whom MAXHUB has disclosed certain categories of Personal Data during the preceding year for the third parties' direct marketing purposes. If you are a California resident and you wish to opt out, please send us an email at support@MAXHUB.com.

m. Additional Rights for Texas Residents

Residents of the State of Texas have the right to opt out of the processing of the Personal Data for purposes of: (A) targeted advertising; (B) the sale of Personal Data; or (C) profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer.

 

 You can get in touch with us and assert your aforesaid right by sending email to support@MAXHUB.com. Upon receipt of your email, we will respond and reply to you as soon as possible. Unless otherwise required by the laws of the state that you are located, generally, we will reply to you within one month upon receipt of your request (If necessary, we may extend it by an additional two months as permitted by law. We will inform you the reason for the extension within the aforementioned 30-day period, such as the request is too complicated or too much in volume).

If you are not satisfied with the response you received, you can get in touch with us and/or refer the complaint to the relevant regulatory authority in your jurisdiction.

7. How We Process Minor’s Personal Data

 MAXHUB Products are not minor-oriented, so we do not collect minor’s Personal Data. Nevertheless, we highly care about minor’s Personal Data protection. If you are a minor’s parent or guardian, and you reasonably believe that we have collected your minor’s Personal Data, please feel free to contact us via the contact details we disclose in the Privacy Policy and show initial evidence or materials to us. If we find that a minor’s Personal Data is collected, we will endeavor to delete relevant data immediately.

 

8. How Your Personal Data Transferred Globally

 We provide MAXHUB Products and relevant services through resources and servers all over the world. In this case, upon your authorization and consent, the Personal Data collected for purpose of product usage information program will be transferred to Germany where the cloud server is located. We will take corresponding protective measures according to the requirements of applicable laws to ensure data security. 

Also, your product usage information may be accessed by MAXHUB headquarters for the necessary purpose of MAXHUB Products maintenance.

By agreeing to the Privacy Policy and using our products, you allow us to process such international transfer.

If you have any question regarding your Personal Data’s security and/or our international transfer manners or would like to withdraw your consent to the international transfer, please contact us via: support@MAXHUB.com.

 

9. How This Privacy Policy is Updated

We reserve the right to update or modify the Privacy Policy from time to time. We will send you update notices through different channels. For significant changes to the Privacy Policy, we will post the notification on our website or push notifications through our device. The Privacy Policy allows adjustments, but we will not diminish your rights under the Privacy Policy without your express consent.

We also keep on file the previous version of the Privacy Policy for your reference. The previous privacy policy may be obtained by contacting us in the method described in Section 10 of the Privacy Policy.

Please read the amended Privacy Policy carefully. If you don't agree to the Privacy Policy, or any amendment or update to the Privacy Policy, you may choose to stop using MAXHUB Products. However, please be aware that the Privacy Policy will still govern your activities before you stop using the service.

Significant changes in the Privacy Policy include but are not limited to:

(1) Our service model has changed substantially. For example, the purpose of processing Personal Data, type of Personal Data processed and method of using Personal Data, etc.

(2) We have material changes in the ownership structure and organizational structure. For example, change in ownership due to business adjustment, bankruptcy, merger and acquisition, etc.

(3) Your rights to participate in the processing of Personal Data and the method of exercising them have changed substantially.

(4) When there is any change in the department responsible for Personal Data security, contact information or the channels of making complaints.

(5) When the Personal Data security impact assessment report indicates a high risk.
